Armstrong’s Certified Used Advantage: Terms & Conditions

1. Program Overview

1.1      The Armstrong’s Certified Used Advantage program is a series of benefits available to Armstrong’s customers purchasing eligible ‘Certified Used’ vehicles from participating Armstrong’s dealerships. Core program benefits include a Safety & Mechanical Inspection completed by a qualified technician, Fixed Price Servicing, Fixed Price WoF Inspections and a 12-month Roadside Rescue membership (all as described further below). References to “Armstrong’s” in these Terms and Conditions means Armstrong’s Motor Group Limited and any of its related companies, subsidiaries, or local dealerships participating in the Armstrong’s Certified Used Advantage program.

2. General Eligibility & Participation

2.1     Armstrong’s Certified Used Advantage program benefits are available on eligible Armstrong’s Certified Used vehicles purchased from participating Armstrong’s dealerships, excluding Auckland City Toyota – (Grey Lynn, Greenlane and Mt Wellington), Porsche Centre Wellington, Audi Wellington, Mercedes Benz Botany, Christchurch and Dunedin, and Land Rover Wellington and Dunedin.

2.2     Armstrong’s Certified Used entitlements are linked to the vehicle’s unique Vehicle Identification Number (VIN) at the time of purchase and cannot be transferred to another vehicle.

2.3     Eligible vehicles will be digitally recorded in Armstrong’s Dealer Management System (DMS) and physically identified by an Armstrong’s Certified Used Advantage sticker, applied by Armstrong’s to the inside of the driver’s door frame. While the display of Armstrong’s branded decals and/or plate surrounds is encouraged to assist with visibility and recognition, it is not a condition of eligibility for entitlements under this programme. Every Armstrong’s Certified Used vehicle undergoes a safety and mechanical inspection prior to sale. Without limiting your rights under the Consumer Guarantees Act 1993, this inspection is carried out at a specific point in time and does not constitute, nor should it be relied upon as, a warranty or guarantee of the ongoing condition or future performance of any inspected items. Normal wear and tear or subsequent faults may arise after the inspection, for which Armstrong’s accepts no liability unless otherwise required by New Zealand law.

2.4     Eligibility of vehicles for the Armstrong’s Certified Used Advantage programme will be assessed by Armstrong’s at its discretion.

2.5     To the maximum extent permitted by law,  Armstrong’s shall not be liable for any loss, damage, cost, or expense (whether direct, indirect, or consequential) arising solely from participation in the Armstrong’s Certified Used Advantage program or reliance on its entitlements, including the Safety & Mechanical Inspection, Fixed Price Servicing, Fixed Price WoF, Roadside Rescue or any related services. This limitation does not exclude or restrict any liability that Armstrong’s would ordinarily accept under its usual terms and conditions, which continue to apply in full and are unaffected by this programme.

3. Terms applying to Fixed Price Servicing

3.1      Fixed Price Servicing is only available when the service is carried out at a participating Armstrong’s dealership.

3.2      Fixed Price Servicing must be requested at the time of booking or upon vehicle drop-off. Bookings are essential, and Fixed Price Servicing will not be applied retrospectively.

3.3      A vehicle’s first service will be scheduled at, or shortly after, delivery. Where pre-booked, Armstrong’s will provide reminder notifications prior to the due date; however, it remains the customer’s responsibility to ensure the vehicle is serviced in line with the manufacturer’s recommended service schedule, which may vary by brand and model (for example, 12 months or 15,000kms, whichever comes first).

3.4      Armstrong’s Fixed Price Servicing is not a substitute for manufacturer scheduled servicing requirements that may be necessary to maintain or activate specific manufacturer warranties. Servicing requirements differ by manufacturer and model. It is the customer’s responsibility to ensure that all required manufacturer servicing is completed in order to maintain or activate warranty coverage. Armstrong’s will not be held liable  for any loss, damage, cost, or expense (whether direct, indirect, or consequential) arising from or in connection to any warranty that is voided as a result of manufacturer scheduled servicing not being completed.

3.5      It is the customer’s responsibility to ensure the vehicle is serviced at the correct intervals, whether by time or distance, in accordance with the manufacturer’s requirements. If in any doubt, please ask our sales and service teams who can advise you of this specific to your vehicle. Failure to service the vehicle at these intervals may affect the validity of any applicable manufacturer warranty.

3.6      Fixed Price Service packages use high-quality, genuine and non-genuine branded parts and consumables. Exclusively genuine OEM parts can be supplied on request at an additional cost.

3.7       Fixed Price Service packages exclude wear-and-tear items including but not limited to brakes, tyres, and wiper blades. Replacement wear and tear items can be supplied on request at additional cost.

3.8      Where additional repairs or parts are required; Armstrong’s will provide a separate quote. No work outside the Fixed Price Service package will proceed without the customer’s prior written or verbal authorisation.

3.9      Payment for all Fixed Price Services must be made in full prior to vehicle release, in line with Armstrong’s standard practice.

3.10     Fixed Price Servicing on eligible Certified Used vehicles is available at Armstrong’s current Fixed Price Service rates and in line with Armstrong’s category definitions, which may be updated from time to time. Details are available from Armstrong’s on request.

3.11      Standard Fixed Price Service packages include synthetic oil (capped at 5L). Premium and European Fixed Price Service packages include synthetic oil (capped at 7.5L).

4. Terms applying to Fixed Price Warrant of Fitness (WoF)

4.1       Fixed Price WoF is only available when carried out at a participating Armstrong’s dealership.

4.2      WoF pricing covers the inspection only. Repairs required for a pass are at the vehicle owner’s expense.

4.3      If a vehicle fails its WoF, in line with NZTA requirements, reinspection must occur within 28 days to avoid further charge of reinspection.

4.4      Fixed Price WoF is not transferable for any other type of vehicle inspection or servicing.

4.5      Payment for Fixed Price WoF must be made in full prior to vehicle release.

4.6      Fixed Price WoF inspections on eligible Certified Used vehicles are available at Armstrong’s current Fixed Price WoF rates, which may be updated from time to time. Details are available from Armstrong’s on request.

5. Exclusions

5.1      The Armstrong’s Certified Used Advantage programme excludes high-end, exotic, and specialist vehicles, including but not limited to: Lamborghini, Ferrari, McLaren, Rolls-Royce, Bentley, Aston Martin, Porsche, Maserati, and other high-performance and niche models as determined at the sole discretion of Armstrong’s. Armstrong’s reserves the right to amend or expand the list of excluded vehicles at any time.

5.2       Certain vehicles may not qualify for Armstrong’s standard Fixed Price Service or WoF rates due to their unique servicing requirements. This includes:

(i) Performance models or specialised European variants; and

(ii) EVs requiring non-standard servicing, battery diagnostics, or coolant changes.

(iii) Vehicles aged 20 years or older from manufacturer date.

Where a vehicle is excluded from standard pricing, Armstrong’s will confirm the applicable rates on request.

6. Vehicle Category Definitions

6.1       For the purposes of the Armstrong’s Certified Used Advantage programme, all eligible vehicles are placed into one of Armstrong’s defined vehicle categories. The benefits and associated pricing available under the programme apply according to the category assigned. The vehicle’s category is determined at the reasonable discretion of the participating Armstrong’s dealer and will be confirmed to the customer at the time of purchase as part of the delivery pack. Armstrong’s maintains and updates its vehicle category definitions from time to time, and details are available from Armstrong’s on request.

7. Terms applying to Roadside Rescue

7.1       Armstrong’s Roadside Rescue entitlement is valid for 12 months from the date of vehicle purchase.

7.2       The service is provided and operated by First Rescue and is subject to their terms and conditions, available at [https://firstrescue.co.nz/].

7.3       The entitlements and exclusions described in relation to Roadside Rescue reflect the benefits offered under the First Rescue membership as at the date of these terms. First Rescue may amend its membership entitlements from time to time, and any such changes will apply to customers covered by this benefit.

7.4       Customers are responsible for familiarising themselves with those terms and conditions. Armstrong’s does not operate the Roadside Assistance service and will not be liable for any loss, damage, cost, or expense (whether direct, indirect, or consequential) arising from or in connection with Roadside Assistance and accepts no liability for its delivery, limitations, or exclusions.

7.5       Customers are not required to register separately for this benefit, which is automatically activated upon vehicle delivery.

8. General Terms

8.1       Under the Armstrong’s Certified Used Advantage programme and its associated ownership benefits, the customer acknowledges that Fixed Price Servicing covers only the scheduled servicing and maintenance items specified in the programme and available to the customer on request. All other work – including repairs, consumables, wear-and-tear items, accident-related work, and non-scheduled maintenance – is excluded from the programme and will incur additional charges.

8.2      The customer is responsible for maintaining the vehicle with reasonable care and proper use for the Armstrong’s Certified Used Advantage programme to apply. Armstrong’s reserves the right to void coverage where a vehicle has been misused, neglected, modified in an unsafe, unauthorised, or irresponsible manner, or where unauthorised repairs have been undertaken.

8.3      Armstrong’s Certified Used Advantage entitlements such as Roadside Rescue, Fixed Price Servicing, Fixed Price WoF, and any other specials or discounts are, to the maximum extent permitted by law, provided as-is, subject to availability, and may change without notice, with no liability accepted by Armstrong’s for third-party providers. Armstrong’s liability is limited strictly to the value of services provided to customer under the Armstrong’s Certified Used Advantage programme, and it accepts no responsibility for any indirect, incidental, or consequential loss.

8.4      Armstrong’s may amend these Terms and Conditions from time to time. Any changes will take effect from the date they are notified to the customer. Armstrong’s reserve the right to add, vary or withdraw certain aspects of the Armstrong’s Certified Used Advantage programme at any time.

8.5      If any provision of these Terms is found by a court or other competent authority to be invalid, unenforceable or in conflict with law, that provision is limited or eliminated to the minimum extents so that these Terms and Conditions remain in full effect.

8.6      If Armstrong’s does not exercise or enforce any right available to it under these Terms and Conditions, it does not constitute a waiver of those rights.

8.7       Nothing in these Terms and Conditions is intended to limit the application of the Consumer Guarantees Act 1993.

8.8      These terms and conditions are governed by New Zealand law and are subject to the exclusive jurisdiction of its courts.
